(2) If the User requests Disclosure, Correction, Utilization Cease, etc. of Personal Data etc., or of records (in relation to Personal Data etc. as defined in Article 29, Paragraph 1 and Article 30, Paragraph 3 of the Personal Information Protection Law) provided to Our Company by a third party, Our Company will perform Disclosure, Correction, Suspension of Use, etc. of Personal Data etc. within reasonable limits, after confirming the identity of the User, unless if it falls under the following Exceptions, and if it falls under the following Indisputable Reasons.
If the request is made by a proxy of the User, identity verification documents will be required for the proxy as well. In addition, a handling fee may be charged in case of Disclosure of Personal Data etc.
Exceptions
① If there is a risk of harming the life, body, property or other rights and interests of the User or of third parties
② If there is a risk of significant hindrance to the proper implementation of Our Company's business
③ If there is a risk of violating the law
Indisputable Reasons
① If utilization cease or deletion (“Utilization Cease etc.”) is requested in accordance with the Personal Information Protection Law in case Personal Data etc. collected from the User is used beyond the scope of the purpose of use initially declared, Personal Data etc. is used in a way that may promote or induce illegal or unlawful acts, Personal Data etc. is acquired by fraudulent means
② If Utilization Cease etc. is requested in accordance with the Personal Information Protection Law in case Personal Data etc. is shared with a third party without the consent of the user
③ If Our Company no longer needs to use the User’s Personal Data etc.
④ If Utilization Cease etc. is requested in accordance with the Personal Information Protection Law, when it has become clear that there is a reason in the demand, and after confirming the identity of the User, as stipulated in Article 26, Paragraph 1 of the Personal Information Protection Law, if the handling of the User's Personal Data etc. may harm the rights or legitimate interests of the user, our Company will perform Utilization Cease etc. of Personal Data etc. without delay and notify the User to that effect. However, we will only comply with Utilization Cease etc. of Personal Data etc. if the request falls under the Personal Information Protection Law or other laws and regulations.
⑤ If the Personal Data etc. held by Our Company is used beyond the scope of the purpose of use, if Personal Data etc. is obtained by deception or other improper means, or if Personal Data etc. is provided to a third party without a justifiable reason such as without the consent of the User.
Even if the Indisputable Reasons ① to ⑤ apply, however, in case the Utilization Cease etc. of Personal Data etc. requires a large amount of expenses, in cases where it is difficult to fulfill Utilization Cease etc., or when necessary, alternative action will be taken to protect the User’s rights and interests.
(3) Procedure for Disclosure etc.
To request Disclosure, Correction, Utilization Cease, etc. of Personal Data etc., the User can contact Our Company at the following address. Our Company requires proof of identity of the User or their proxy.
